This also means that if ONE letter of recommendation is requested, sending THREE is not going to impress the judges. The easiest way to make sure all materials are included for each scholarship application is to print-out the guidelines and physically cross-out each item as it is uploaded or placed in the envelope for mailing. Students who dont follow directions drive scholarship judges crazy! This also goes for simple directions such as essay word count, eligibility requirements, and G.P.A. levels. Students simply waste their time and that of the judges when they do the work and apply for scholarships in which they do not meet the specific guidelines. Simple Grammar Mistakes Can Be Deadly Students in this day and age really dont have an excuse for submitting a scholarship essay full of grammatical errors. With free writing tools such as spell check and Grammarly, it only takes a few minutes to find out if an essay needs fixing. In addition, having someone else proofread each essay before submitting is just plain SMART. The proper use of paragraphs is also important. Reading one long paragraph of 500-1000 words or more is hard on the eyes because the words tend to run together. As a scholarship judge, reading an essay response that is one giant paragraph causes my eyes to mindlessly drift down the page and frankly, drives me up a wall. Also frustrating is reading an essay full of abbreviated text or SMS language, such as YKWIM? (You Know What I Mean?) Scholarship judges dont have the time to guess or decipher the meaning of what the student is trying to convey, so using this type of wording is not advisable at all. Scholarship essays are not text messages, so students need to treat them like valuable school assignments. Not Answering The Essay Question This one may surprise you, but it is quite common for students to submit one scholarship essay for multiple scholarship applications and while this strategy works in some cases, it will backfire in others. If the essay prompt or question is the same or very similar for several scholarships, students can go ahead and use previously written essays, but those that blindly include the same essay no matter what the question is will not win over any scholarship judges. What students CAN do is adjust each essay response to properly fit each scholarship application that they submit. The same essay prompt might be used for one scholarship with a requirement of 500 words, while the same answer is needed for another application requiring 700 words. For the longer essay, more details can be shared and examples of real-life situations expanded upon. Another fatal flaw in using the same essay over and over is if the student included the name of the scholarship in the body of the essay and forgets to change it for multiple submissions. This constant competition inevitably leads to the war ââ¬Å"of every man against every manâ⬠(Hobbes, Leviathan). The importance of the Leviathan is thus derived from Hobbesââ¬â¢ account of what life would be like devoid of a common political authority in which the passions of human nature perpetuate social and political chaos. While humanââ¬â¢s natural propensity for self-preservation and power perpetuates war and violence in the state of nature, the same desire means humans naturally fear death and injury. In order to achieve this, Hobbes argues humans willingly give up some of their rights to a common authority in order to gain protection from the constant threat of death and anxiety for the future. Hobbes, believes that moral code is strengthened by the existence of an authority figure. In the absence of a strong central authority the boys on the island begin to abandon all morality, eventually behaving in brutish, violent ways. They begin to become concerned only with hunting and a Hobbesian survival of the fittest mentality. Additionally, this film reflects Hobbesââ¬â¢ argument that competition of scarce resources and the desire for power will spark conflict. The competition between Ralph and Jackââ¬â¢s group reflects this, as the two battle for authority and power. The rest of the boys ultimately defect to Jackââ¬â¢s group which pursues that which ensures survival. This conflict ends up creating the most violent behavior of the film, such as Simon and Piggyââ¬â¢s death. Absence of strong central authority and Hobbesââ¬â¢ Leviathan, society and mor ality break down and humans are thrust into the miserable condition that Hobbes anticipates. In The Prince Machiavelli also considers human nature to be inherently ââ¬Å"badâ⬠. He states: ââ¬Å"For this can be said of men: that they are ungrateful, fickle, liars and deceivers, avoiders of danger, [and] greedy for profitâ⬠. The nature of man thus results in war, violence, and self-serving political actors. Machiavelli argues that humans naturally bad behavior must be mitigated by a prince whose main goal is to safeguard the state and secure power. Machiavelli believes that manipulation is the most essential tool to maintain power and control. In chapters 6-9, Machiavelli identifies ways in which a prince can rise to power. The distinction Machiavelli makes of these conditions demonstrate Machiavelliââ¬â¢s argument that a prince can only be successful in reducing political violence if he has the ingenuity to use ethics and violence properly. That is, that he can first positively manipulate the peopleââ¬â¢s view of himself and use violence such that his authority is not questioned. He thus has not guarded against attack by enemies and runs the risk of destruction caused by war ââ¬Å"for a man who strives after goodness in all his acts is sure to come to ruin, since there are so many men who are not goodâ⬠(Machiavelli, The Prince). A second way a prince can be elected is through cruel and immoral means, relying heavily on violence (Machiavelli, The Prince). In this condition, the prince is feared, but is hated by his subjects. Machiavelli identifies hate as a real danger which causes a lack of loyalty among subjects and alliances and an environment of paranoia. In both conditions, the prince is unsuccessful in maintaining power and controlling for political violence. The most successful prince, according to Machiavelli, is one who is both loved and feared. This means he uses violence in order to deter individuals from challenging his authority, but not insofar that he is hated. It also means that he is ââ¬Å"goodâ⬠, or manipulates the positive view of himself, to the degree that he gains the support of his subjects. According to Machiavelli, it is essential that the prince uses both these instruments to end the destruction caused by war and greedy, self-seeking political actors. In the film Dangerous Liaisons, one can also see the use of manipulation in acquiring power. Meteuil and Valmont decide to manipulate the people around them for their own personal gain. As we see in Lord of the Flies, and in many instances throughout history, when civilized rule and safety is removed people will often turn to the militant mindset. When people are not protected from the constant fear of death and uncertainty, the integrity of the sovereign is lost and individuals resort to those passions that ensure survival. Once they have resorted to self-preservation, society can no longer function peacefully. However, when the Leviathan is in place, individuals are bound by civil laws and morality that prevent the passions of man from creating conflict and constant war. All participants in the commonwealth agree to give up their own rights to violence and cede to the sovereign. Jackson met with many of the Native American tribes before making his decision. In one document he even referred to the Native Americans as friends and his red children. However, even though Congress voted against the removal of the humble natives Jackson still signed the document to have them removed. In Jacksons eyes, removing natives was the key to success. He belived them to be infirior to whites. He stated,under the protection of the Government, and through the influence of good councels, [will cause them] to cast off their savage habits, and become an interesting, civilized, and Christian community. In the letter from the secretary of war it is even mentioned that they would erect new building as soon as possible where the Native Americans homes once were. Both accounts take place in nature, or the garden, they are tempted by a serpent, gain knowledge, and suffer for them gaining that knowledge. In ââ¬Å"Young Goodman Brown,â⬠Brown leaves the comfort of Salem and travels into nature, where he is tempted by a man with a ââ¬Å"staff, which bore the likeness of a great black snakeâ⬠(627), as Hawthorne writes. The man tells Brown, ââ¬Å"ââ¬â¢Come, Goodman Brown,ââ¬â¢ [â⬠¦] ââ¬ËTake my staff, if you are so soon wearyââ¬â¢Ã¢â¬ (627). This same thing occurs in the Garden of Eden when Eve is tempted by the serpent to eat the forbidden fruit. After Brown is tempted and falls under the temptation, he gains knowledge that has an effect on every man in the world to come. He learns that deep inside every man, darkness and evil hide, even in the hearts of the most ââ¬Å"righteousâ⬠men. In the Garden of Eden, Adam and Eve both gain the knowledge of sin and how they can do things for their own pleasure rather than for the grace of God. After Goodman Brown gains his knowledge, he will suffer. Brown understands that these people, who are thought to be righteous and holy, really are dark and evil people. Every time Goodman Brown hears the minister or Deacon Gookin sing the church hymns or preach their word, he understands the things they are saying have a deep, evil meaning behind them. Brown cannot stand to have this knowledge and hates knowing that these people, who he himself looked at as holy, are dark, evil people. Adam and Eve also suffered in the Garden of Eden after falling to the temptation of the serpent. When Eve ate from the forbidden fruit, sin came upon them and when they had children, they revolted against each other and eventually led to Cain slaying his brother Abel. Throughout ââ¬Å"Young Goodman Brown,â⬠it is evident that it is representing the trials and tribulations that Adam and Eve went through in the Garden of Eden. Although Nathaniel Hawthorne did not intend to incorporate many of these archetypal symbols, as mythological and archetypal critics, the audience can dig deep into those symbols to understand a deeper meaning to the story. Occupierââ¬â¢s Liability: Homeless Persons Vacant Site: The frequenting of homeless people may give rise to legal liability if the site is not appropriately secure to prevent access. Section 1(1) of the Occupiers Liability Act 1957 (OLA 1957) provides a duty of care to visitors on the site (Adriaanse, 2010, p. 126).à A homeless person will not be identified as a visitor; rather he/she will be a trespasser. However, the Occupiers Liability Act 1984 (OLA 1984) requires that visitors on a construction site without invitation also have to be protected. It is arguable that the property is not a construction site yet, but this does not mean that there should be no protection for trespassers at all. Rather, there is still an obligation to prevent harm to trespassers. Under s. 1(2) OLA 1957 it provides that there is an obligation to protect licensees. A licensee can be a trespasser who enters the land where the occupier is aware of the trespass and the danger (Lowery v Walkerà [1911] AC 10). Without knowledge of the trespass, there will not be a direct obligation (Edwards v Railway Executiveà [1952] AC 737). Taylor v Glasgow City Councilà [1922] 1 AC 44à indicates that if there is an allurement on the land, such as a vacant property then a license may be implied. This has been limited with OLA 1984, as such there is a reluctance to impute an implied license based on allurement alone (i.e. the imputed knowledge that individuals will enter the land) (Tomlinson v Congletonà [2003] 3 WLR 705). The implication is that the accessibility of the site is not enough to impute occupierââ¬â¢s liability. The failure to prevent the homeless persons would give rise to liability under s. 1(2) OLA 1957. To discharge liability under s. 1(2) OLA 1957, ABC has to take all reasonable acts to make the property safe (s. 2(2) OLA 1957). It is possible for him to discharge liability through a notice, which identifies that no trespassers are allowed (Roles v Nathanà [1963] 1 WLR 1117) and the danger of the site is identified (White v Blackmoreà [1972] 3 WLR 296). Recommendation: Therefore, a sign that clearly should be posted, which states that: No trespassers are allowed; and The dangers of the site The posting of the sign should be at all possible access points, in order to exclude liability. Liability for Active Construction Site: When the site becomes active, there may be dual liability under OLA 1957 and OLA 1984 for ABC and XYZ. This will depend on the nature of control by ABC and XYZ (Adriaanse, 2010, p. 126). For XYZ to be held as an occupier, it should have a degree of control and supervision (Wheat v Lacon [1966] AC 552). As XYZ is the controlling contractor then it will owe an obligation to prevent visitors, employees and sub-contractors from dangers caused by physical defects on the site (Bunker v Charles Brand [1969] 2 QB 480). It is important to stress that there is an obligation on ABC and XYZ to secure the site, which includes all moveable; otherwise liability may arise from harm that emanates from the site (Jolley v London Borough Council [2000] 1 WLR 1083). Securing of the site is also important, because if children access it and are harmed then there will be liability, even with signage, due to the frivolity of youth doctrine (confirmed in OLA 1984) (Keown v Coventry Trust Healthcare NHS [2006] EWCA Civ 39). If the harm is caused by an adult entering the site when there is clear signage of danger then there is assumption of risk and no obligation is owed (Tomlinson v Congelton). Recommendation: ABC and XYZ will need to ensure that there are special measures in place to secure the property when it is an active construction site. This is because any harm that emanates from the site needs to be reasonably mitigated (s. 2(2) OLA 1957) to protect third parties on the site or passing by the site. Securing the site, in order to prevent children entering is paramount, because signage is not enough. Nevertheless, such signage is important to prevent liability for adult trespassers, such as the homeless persons. G.Obligations under the PWA 1996: There is an obligation under s. 1(1) PWA 1996 that there must be notification of any work on a party wall, or that may affect a party wall (Jessop, 2000, p. 8). In fact, Excavations below the level of the foundations of nearby buildings also require that there are notifications under s. 6 PWA 1996. Finally, ss. 2 to 5 PWA 1996 provides that works directly on the party walls, which pose harm to the neighbourââ¬â¢s wall must be notified (Bickford Smith and Lamont, 2007, p. 2). The failure for ABC to notify those neighbours under the PWA 1996 will result in a civil breach of the act. In addition, any damage that is caused must be rectified (Geoffrey Kaye v Matthew Lawrence [2010] EWHC 2678). The obligations of notification are as follows: There must be at least one monthââ¬â¢s notice before the construction starts (ss. 2-3 PWA 1996); The neighbours then have the right to consent, consent with provisos or reject the proposed building (s. 4 PWA 1996); and If the neighbour fails to reply and/or no agreement is made then s. 10 PWA 1996 must be engaged (i.e. the dispute resolution procedure) (RICS, 2011; s. 4.1 PWA 1996). A security may be requested by the affected neighbours in case there is harm to the party walls ( 12(1) PWA 1996), in order to meet the obligation of rectification. The failure to engage the notice procedure is too big a risk, because if notice is not served, and harm occurs then there is a presumption of negligence that cannot be discharged (Roadrunner Properties Limited v (1) John Dean (2) Suffolk and Essex Joinery Limited [2003] EWCA Civ 1816). Recommendation: It is essential that ABC serves notices of all neighbours that fall under the PWA 1996; otherwise, it will be in breach of the act, and if harm occurs, there is a presumption of negligence that cannot be waived. Rather, it is the obligation of ABC to prove they were not liable for the harm, which is difficult due to the nature of the harm. ABC may argue that they are not liable, because such an act is delegated to XYZ and liability limited. However, the PWA 1996 holds the property owner liable, which cannot be delegated. H. Conclusion: To summarise the following recommendations identified in each of the sections highlight that there are obligations that ABC and XYZ will owe. Many of the obligations cannot be excluded through limitation of liability clauses and notices. Those that do allow limitation of liability requires reasonable steps to be taken, in order to notify persons of the potential harm (e.g. proper and sufficient signposting of the danger of the site, prohibition of trespassers and limitation of liability). Thus, the overall advice that is given is that ABC and XYZ do not cut corners and fully comply with the law, especially the PWA 1996 due to the nature of the construction project.
